2. Collecting Personal Information
2.1. Registration Information. When Member signs up for a PHONEXIA account in order to be allowed to use PHONEXIA Services, Member must provide certain personal information, such as: name, email address, phone numbers, and an account password or other information specified in PHONEXIA account. Additionally, Member may be asked to provide various personal details which would be used solely for internal PHONEXIA analyses. This requested information may include, but not be limited to, date of birth and general demographic information.
2.2. Account Activity. Once Member’s PHONEXIA account has been established and is in use, PHONEXIA may record and process information about your usage, such as: frequency of access to account, frequency of uploading audio, video or other files, the size of Member generated content/storage capacity and other activity in conjunction with Member’s use of PHONEXIA Services. PHONEXIA reserves the right to record other information about your usage of PHONEXIA account, provided that such information would be specified in PHONEXIA account.
2.3. Computer Browser. Additional information collected by PHONEXIA may include information provided by Member’s computer browser as a result of cookies placed by PHONEXIA. By using the Services, you agree to use of the cookies. Furthermore, certain information provided by Member´s computer browser might be provided to third parties, such as browser developer.
2.4. Purpose of Collecting and Processing of Member´s Personal Information. All information submitted by Member and gathered by PHONEXIA helps PHONEXIA to modify PHONEXIA Services to better meet the needs of users of PHONEXIA Services. This information also ensures that PHONEXIA has a detailed understanding of our Members’ demographics and account usage, which contributes to our customer acquisition and marketing strategies, as well as our product research and development.
2.5. Personal Information of Third Parties. If Member provides the personal information of a third party to PHONEXIA, Member warrants that Member is authorized to provide such information including the approval of PHONEXIA to collect and use such information in the same manner as Member´s personal information.
2.6. Accuracy of Information. Member ensures that information submitted to PHONEXIA is current and accurate. PHONEXIA provides Member with access to personal information via their account, enabling Member to update such information as needed.
3. Use of Personal Information
3.1. Use of Personally Identifiable Information. PHONEXIA is entitled to share Members’ personally identifiable information with third-parties in the following situations:
If PHONEXIA believes it is necessary to respond to legal action or an enforceable governmental request;
To enforce Terms of Service;
To address fraud, security or technical issues; or to protect the rights, property or security of PHONEXIA, its members and the public;
As part of a contract with PHONEXIA business partner;
In connection with a corporate merger, acquisition or other corporate reorganization.
3.2. Use of Non-Personally Identifiable Information. The Members’ non-personally identifiable information may be used in the following ways:
To communicate with our Members. Opt-out options are made available;
To modify PHONEXIA’s Services to better meet the needs of our Members;
To develop a detailed understanding of our Members’ demographics and account usage for PHONEXIA Service´s research and development;
To analyze our business, customer service, advertising and marketing strategies;
3.3. Renting or Selling Information. PHONEXIA does not rent or sell its Member´s personal identifiable information.
3.4. Opt-In Policy. If PHONEXIA wishes to use or disclose your personal information in a manner not laid out in this policy, you will be requested to provide opt-in consent (give permission).
4. Content Handling
4.1. PHONEXIA Access To Member Information & Accounts. Access to personal information, Members’ accounts, and Member generated content (e.g. uploaded audio or video recordings, transcripts of PHONEXIA recordings, or other files) is restricted to a limited number of PHONEXIA employees, contractors, agents and business partners who require access in order to conduct PHONEXIA business. These PHONEXIA team members operate under strict confidentiality policies and may be subject to discipline, termination and even criminal prosecution if they digress from PHONEXIA policies.
4.2. Purpose of Access to Member Accounts. PHONEXIA will access Members’ accounts for the purpose of determining causes and solutions to technical issues, and to conduct speech research in relation to the continued development of our recognition methods. PHONEXIA does not warrant that Member generated content will never be seen or heard by PHONEXIA representatives. PHONEXIA may be required by a governmental or legal request to access and/or disclose your personal information and the content of your communications in the case of a search warrant, subpoena, court order, or other legal process.
4.4. Data Security. PHONEXIA works hard to consistently provide a high level of security to protect Members’ personal information, accounts, and content. This security involves limiting access to key representatives, firewalls, encryption of communication and data transmissions, and other physical security procedures at all PHONEXIA data centers, such as intrusion detection systems. These security measures are constantly monitored and reviewed to protect Member data.
4.5. Consent To Record Calls. Once PHONEXIA enables phone calls recording service as part of PHONEXIA Services and Member will decide to use such call recording service, Member will be required to request and receive consent from all involved parties for each individual call made. It will be the Member’s responsibility to ensure that consent is received in accordance with all applicable laws.
4.6. Storing Content. Member has the option of deleting any audio files or transcribed content within their account. Once deleted, said content may remain archived for back-up purposes within the PHONEXIA system for a period of time. PHONEXIA retains no liability in the case that content becomes lost due to deletion by Member.
5.2. Disabling Cookies. Member may set your browser to disable cookies. Please keep in mind, however, that if you disable cookies, you may affect your experience when using our services.
6.1. Third Parties Partnerships. PHONEXIA may become involved in a commercial partnership with another service or application provider. As a result other services or applications may be offered to PHONEXIA Members. Upon accepting use of these commercial offers, Member gives permission to PHONEXIA to share their demographic or other information, as specified in detail by PHONEXIA on its website, with its commercial partner for use in developing marketing and advertising strategies.
7. Third-Party Websites
7.1. Third-Party Websites, Products or Services. PHONEXIA may provide Members with links to third-party websites, products or services. PHONEXIA does not have control over such websites, products or services, their privacy policies, or the manner in which they gather and handle your personal information. They may also place cookies or other files on your computer. It is Member’s responsibility to read all terms of service and privacy policies related to third-party websites, products and services.

10. Access to your data and your rights
10.1. If your personal information provided to PHONEXIA is incorrect or if you believe that our processing of your personal data is in contradiction with the protection of your private and personal life or in contradiction with the law, you have the right to access and correct your personal data, to request blocking, correction, supplementing, or liquidation of your personal data; further, you have the right to appeal directly to the relevant Data Protection Authority.
10.2. You can at any time request information about the processing of your personal data, and we will provide such information to you free of charge.
10.3. In addition, you may revoke your consent allowing PHONEXIA to process your personal data at any time; however, in such case, we may no longer be able to offer you PHONEXIA Services.
